These Terms of Service (“Terms”) govern your access to and use of the FixyPaint website, store, and related services (the “Services”).
The Services are powered by Shopify, which provides the e-commerce platform that allows us to sell products to you.
By visiting, browsing, or making a purchase through the Services, you agree to be bound by these Terms and by any policies referenced
in these Terms (including our Return & Refund Policy and Privacy Policy). If you do not agree, do not use the Services.

1) WHO WE ARE
“FixyPaint”, “we”, “us”, and “our” refers to the FixyPaint store operated from Lithuania.

2) ELIGIBILITY
You must be at least the age of majority in your place of residence to use the Services and make purchases.
You agree that any information you provide is accurate, current, and complete.

3) OUR PRODUCTS (IMPORTANT)
FixyPaint products are CUSTOM MIXED and made-to-order based on the paint code selected on our website.
Because custom-mixed paint is made to the customer’s specifications, it is not eligible for “change of mind” returns.

4) ORDERS AND ACCEPTANCE
4.1 Order confirmation
After you place an order, you may receive an order confirmation email. This does not guarantee acceptance.
We reserve the right to accept, refuse, cancel, or limit any order at any time for legitimate reasons,
including suspected fraud, errors, or operational limitations.
4.2 Accurate order details
You are responsible for ensuring your order details are correct, including the selected paint code, product selection,
quantity, and shipping address.
4.3 Cancellations
Because custom-mixed products may enter production quickly, cancellations are not guaranteed.
If you need to request a cancellation, contact support@fixypaint.com immediately.
If production has started or the order has shipped, cancellation may not be possible.

5) PRICES, TAXES, AND PAYMENTS
5.1 Pricing
Prices shown on the website may change without notice. The price charged is the price shown at checkout.
5.2 Taxes and duties
Depending on your location, taxes (including VAT) may apply.
For international orders, import duties, taxes, and fees may be charged by your local authorities and are the buyer’s
responsibility unless stated otherwise at checkout.
5.3 Payments
Payments are processed through Shopify and/or third-party payment providers.
We do not store full payment card numbers.

6) SHIPPING AND DELIVERY
6.1 Shipping
We ship worldwide where available. Shipping options, costs, and estimated delivery times are shown at checkout.
6.2 Delivery estimates
Delivery estimates are not guaranteed and may vary due to carrier delays, customs processing, peak seasons, weather,
or other factors outside our control.
6.3 Address responsibility
You are responsible for entering the correct shipping address at checkout.
If an order is returned to us as undeliverable, we may offer re-shipment (buyer pays new shipping cost) or handle
the situation case-by-case.
6.4 Delivered but not received
If tracking shows DELIVERED but you did not receive the parcel, you must contact your local carrier first and request
delivery details. Then contact us with your findings. (See Return & Refund Policy for details.)

7) RETURNS, REFUNDS, AND PROBLEM RESOLUTION
Return/refund rights and the process for damage, leakage, missing items, wrong items, or defects are described
in our Return & Refund Policy.
By purchasing, you acknowledge that you have read and understood the Return & Refund Policy.

8) PRODUCT USE, SAFETY, AND RESULTS DISCLAIMER
8.1 Use at your own risk
You are responsible for reading and following all instructions and safety guidance provided with the product or on the website.
8.2 Results can vary
Color appearance and repair results can vary depending on surface preparation, primer/base, clear coat, number of coats,
drying time, lighting, and original paint age/fading/oxidation.
Testing on a small, less visible area is recommended.
8.3 Professional use
If you are unsure about application, consult a professional.

9) WARRANTY AND LIMITATION OF LIABILITY
9.1 Statutory rights
Nothing in these Terms limits rights you may have under applicable consumer laws that cannot be excluded.
9.2 Limitation of liability (to the maximum extent permitted by law)
To the maximum extent permitted by law, FixyPaint is not liable for indirect, incidental, special, consequential,
or punitive damages, or for loss of profits, revenue, data, or goodwill arising from your use of the Services or products.
To the maximum extent permitted by law, FixyPaint’s total liability for any claim related to an order will not exceed
the amount you paid for the product(s) giving rise to the claim.
9.3 No guarantees
Except where required by law, the Services and products are provided “as is” and “as available”, without warranties
of any kind, express or implied.

10) INTELLECTUAL PROPERTY
All content on the Services, including text, graphics, logos, product names, designs, photos, and code, is owned by or
licensed to FixyPaint and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from our content without our written permission.

11) USER CONTENT (REVIEWS, MESSAGES, SUBMISSIONS)
If you submit reviews, comments, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use,
reproduce, publish, and display that content for store operation, marketing, and customer support, unless prohibited by law.
You must not submit content that is illegal, misleading, abusive, infringing, or violates the rights of others.

- use the Services for unlawful purposes
- attempt to interfere with the security or operation of the website
